This privacy policy (“Privacy Policy”) applies to the website of Advertising Digital Identification, LLC (“AD-ID”) located at www.ad-id.org, and any associated websites, mobile sites and applications, products, site services and software (including, without limitation, the AD-ID Software (defined below) (collectively, the “Sites”), which provides standardized identification for advertising assets, software and data solutions available through the Sites, as well as all other online and offline interactions with AD-ID, including electronic communications between you and AD-ID (collectively, the “Services”). We value your privacy, and we want you to know what information we collect and what we do with it.

When referred to in this Privacy Policy, the term “Personal Information” includes any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, including any information that is subject to applicable data protection laws. This Privacy Policy applies only to Personal Information collected via AD-ID Sites or otherwise in connection with the Services.

By using the Sites and the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Sites or the Services or provide us with any Personal Information. It is important that you read this Privacy Policy together with any other privacy notice we may provide on specific occasions when we are collecting or processing your Personal Information. In addition, use of the Sites may include additional terms and conditions that are incremental to this Privacy Policy. You agree to be bound by this Privacy Policy and any additional terms and conditions posted on the Sites.

We reserve the right to make changes to this Privacy Policy without notice.  Please review the Privacy Policy on a regular basis.  Updated policies will always be posted on this page, and available at the following link: https://ad-id.org/privacy-policy. The effective date of the most recent version of this Privacy Policy will appear at the top of the page. The Privacy Policy in force applies to any information we collect or have collected from you, your data protection rights, and how to exercise them.

The following definitions apply to this Privacy Policy:

  • “AD-ID API” means an API for enabling access to and use of the AD-ID Software and AD-ID Data.

  • “AD-ID Code” means AD-ID’s standardized numeric or alphanumeric unique identifier of an advertising asset in video, audio, image, text or encoded form, used for advertising or marketing in any media, platform or device type which is assigned to an advertising asset using the AD-ID API and AD-ID Software. AD-ID serves as a central registration and assigns AD-ID Codes to assets purchased by AD-ID users through the AD-ID API or AD-ID Software.

  • “AD-ID Data” means all data published or made available through the AD-ID Products (i.e., AD-ID Code, AD-ID Metadata, AD-ID API, AD-ID Software), including the associated underlying AD-ID Metadata, data aggregation, and analytics of data, and reports.

  • “AD-ID Metadata” means the underlying definition, description, taxonomy, hierarchy and mapping of the data associated with AD-ID Data (including data that may be provided by third parties subject to restrictions), which may be text, video, image, audio-based or in other formats, and includes the description of advertising assets associated with AD-ID Codes.

  • “AD-ID Products” means the AD-ID Code, AD-ID Metadata, AD-ID API, and AD-ID Software.

  • “AD-ID Software” means a web-based software application which enables you to search for, create, edit, and void AD-ID Codes and associated metadata for which you have authorization.

1. Information Sharing

     1.1.    Information You Provide to Us Directly.

AD-ID makes available through the Services, certain AD-ID Products. In order to access or use the AD-ID Products, you must register to create a user account and agree to the AD-ID Software End User License Agreement (the “Software EULA”) and any other agreement for which you are required to enter into in order to access and use certain AD-ID Products.  We keep a record of the user profile information you provide, including name, email, address, phone, and job title. For example, we may keep login and search records associated with your user account, and we may keep records of our contacts with you, such as when you communicate with our customer support personnel. We may also collect and store billing information, such as billing contact and address, provided credit card information is never stored.  The AD-ID Software and AD-ID API may also keep an audit trail of user actions. We may cross-reference or match some or all of this data with other data, including Personal Information, that is already in our records or that is later added to our records.

The Sites may also contain areas where you can contact and/or submit information to us. We may keep records of information you submit at our Sites, and we may cross-reference or match this data with other data, including Personal Information, that is already in our records or that is later added to our records.

We may also obtain additional information from you via the Sites and/or Services by means of voluntary surveys, telephone communications, email communications, in-person meetings, and written correspondence. We may keep records of this information, and we may cross-reference or match this data with other data, including Personal Information, that is already in our records or that is later added to our records.

     1.2.    Information We Receive from Third Parties.

We may obtain data from third parties and add it to our records. We may cross-reference or match this data with other data, including Personal Information, that is already in our records or that is later added to our records.

     1.3.    Information Automatically Collected via Cookies and Other Tracking Technology.

We may retain records of the movement of visitors through our Sites and the AD-ID Products. We may do this by means of web logs, cookies, or other tools. Cookies are data files placed on a computer, mobile device or other device (collectively, “Device”) when it is used to visit our Sites. We may use persistent and/or session cookies to personalize and improve your experience on our Sites, to prevent multiple sign-ins to the same user account, to facilitate surveys and other communications, and for other similar purposes. Persistent cookies: (a) help the Sites remember your information and settings for future visits; (b) are saved in your web browser; and (c) remain in your web browser after you close your web browser unless you delete them. Session cookies: (a) ensure that you are recognized on the Sites; and (b) expire when you close your web browser.

We may use additional tracking technology, such as web beacons, within emails or other communications. These technologies help us to track, for example, whether an email recipient has completed an event, such as signing up for a free trial.
We may cross-reference or match some or all of this data with other data, including Personal Information, that is already in our records or that is later added to our records.

2. Using Your Information

     2.1.    How We Use and Share Your Information We Collect.

AD-ID may use your Personal Information to operate our business, including to provide, personalize, and improve or otherwise develop the Sites and AD-ID Products, and provide and administer the Services.
We use your information to communicate with you and to develop programs, services, and content suited to your needs and to those of our other members and visitors. We may use information we collect to perform statistical and business analysis and to verify data integrity and security; we may engage third parties to assist us in these tasks, but we will require them to protect your information consistent with the terms of this Privacy Policy.

We may from time to time send promotional email messages and announcements and post messages within the Sites and Services. These messages will contain instructions for how to unsubscribe from future such messages, if you wish to do so. We may send emails via third-party service providers, but we will enter agreements with such providers that restrict their use of Personal Information to a specific campaign and require them to destroy such information after completion of the campaign.

We may analyze and use information we obtain on an aggregated basis, combining data of multiple users, but we will remove Personal Information (such as names and email addresses) from such aggregated data. We use aggregated data for a variety of purposes including analysis of the performance and content of our Sites, assessment of member interests, and improvement of our business.  We may also provide aggregated data to third parties.

As part of certain Site functionalities, users of the same Site account may have access to certain Personal Information of the other permissioned users of that same Site account. AD-ID does not otherwise publish, rent, or sell to third parties the Personal Information it obtains.  In addition, we may from time to time seek your approval to provide information about you to third parties.  If you provide permission, or otherwise when we have a legitimate business or legal need to share your information, we may share your Personal Information to third parties outside the scope of this Privacy Policy.

We may provide some or all of the information and data we have obtained to a successor to our business or to a company that merges into us or into which we are merged. In the event of a bankruptcy of AD-ID, the information and data we have obtained may become part of our bankruptcy estate and may be sold or otherwise disposed of by a bankruptcy trustee or otherwise.
We may provide information and data we possess to a third party in response to legal process, such as a court order or subpoena. We may provide information and data we possess to a third party in order to protect the personal safety of individuals and/or to protect the safety of property, including intellectual property.

     2.2.    Your Right to Modify Your Personal Information.

You may modify your Personal Information that you have provided to us, or you may remove yourself from our mailing lists, by sending email instructions to our Customer Service department at: cs@ad-id.org.

You may also be able to modify your information within the AD-ID Products, as further described in the AD-ID Software EULA and the AD-ID API EULA or other agreements entered into by and between you and AD-ID.  We will endeavor to comply with your requests as soon as possible.

3. Security

AD-ID endeavors to protect the security of your Personal Information and your choices for its intended use. We follow generally accepted industry standards to protect the Personal Information submitted to us.  No method of data transmission or of electronic storage is 100% secure. So, while we strive to use appropriate means to protect your Personal Information, we cannot guarantee its absolute security.

If you choose to share your information with other companies or sites, including those with which we may have marketing or other relationships, you should check their privacy and cookie policies to ensure you are comfortable with their use of your information. Their practices may not be the same as ours, and we cannot be responsible for their actions.

The safety and security of your information also depends on you. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or user account has been compromised, you should change it immediately.

4. Third Party Links

We may display links to other sites within the Sites and Services. We do not control those sites and cannot be responsible for their use of data or their privacy policies or practices. You should check their privacy and cookie policies to ensure you are comfortable with their use of your information.

5. Copyright/Trademark Notice

The AD-ID logo and other AD-ID icons, images and content on our Sites and Services are owned exclusively by Advertising Digital Identification, LLC, and any use of such marks without the prior express written permission of AD-ID is hereby strictly prohibited. In addition, the name AD-ID and the AD-ID logo are trademarks of Advertising Digital Identification, LLC. Other product and company names on the Sites and Services may be the trademarks and/or service marks of their respective owners.

6. Data Retention

Except to the extent prohibited by law, and subject to this Privacy Policy, we will retain and use your Personal Information for as long as it is needed to provide you with any Services, communications, or access to the Sites, to document our business relationship with you, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Pursuant to the EU General Data Protection Regulation 2016/679 (GDPR) and where allowed by law, such as in the European Economic Area (EEA), United Kingdom, and Switzerland, and provided that the legal preconditions are fulfilled, if you are a resident of the EU, United Kingdom, or Switzerland, you have the right to:

  • access your Personal Information;

  • ask us to correct your Personal Information;

  • ask us to delete your Personal Information;

  • ask us to restrict processing of your Personal Information;

  • obtain your Personal Information in a structured, machine readable format for data portability purposes;

  • withdraw your consent at any time by emailing us at cs@ad-id.org.

In addition, you can object to the processing of your Personal Information in some circumstances (including where we are using the data for direct marketing).

You further have the right to lodge a complaint with a data protection supervisory authority if you believe that our processing of your Personal Information does not comply with GDPR.

These foregoing data subject rights may be limited, for example, if fulfilling your request would reveal Personal Information about another person, or if you ask us to delete information which we are required by law to keep or have overriding legitimate interests in keeping. Legal Grounds for Processing

The processing of your Personal Information is based on the following legal grounds:

For information related to contact information, user accounts, communication and support: We process this data, Art. 6 (1) (b) GDPR in order to:

  • Provide and administer our Sites and our Services;

  • process your requests and orders for the AD-ID Products;

  • respond to an inquiry and any related activity that may result from your inquiry; and

  • post your reviews, comments, feedback and/or questions on the Sites.

For information related to system data and/or usage data: We have a legitimate interest in processing this data, Art. 6 (1) (f) GDPR. Our interests are:

  • ensuring the security and integrity of the Sites and its content; and

  • improving or otherwise develop the Sites, Services, and the AD-ID Products.

For information related to surveys and/or offers: We have a legitimate interest to process Personal Information submitted by voluntary participation in a survey or promotional offer, Art. 6 (1) (f) GDPR. Our interests are:

  • improving our Sites and AD-ID Products; and

  • promoting our Services.

For other information related to your profile or user accounts: We collect and process this data only with your consent, Art. 6 (1) (a) GDPR.

The sharing of Personal Information is based on the following legal grounds:

  • With other users of the Sites: We share your data in order to provide our Services, Art. 6 (1) (b) GDPR.

  • As necessary to administer, market, or sponsor promotions and surveys: We share your data in order to provide our Services according to the survey or promotion, Art. 6 (1) (b) GDPR.

  • With legal, governmental, or judicial authorities: We share your data in order to defend our rights, Art. 6 (1) (c) GDPR.

  • As necessary to pursue a legitimate business or legal need and/or to prevent physical, financial, or other harm, injury or loss: We have a legitimate interest to share your data, Art. 6 (1) (f) GDPR. Our interest is to provide our Services and prevent damages.

  • With third parties outside this Policy; aggregated or de-identified data: We share your data only with your consent, Art. 6 (1) (a) GDPR.

     7.2.    California Residents.

If you are a California resident, you have the right, subject to certain exceptions defined in the California Consumer Privacy Act (CCPA) and other applicable laws and regulations, to request that companies disclose certain information to you about their collection and use of your Personal Information over the past twelve (12) months.  Please also note that we are not required to respond to your requests for access or disclosure of Personal Information more than twice in a twelve (12) month period.

This right of access includes information about:

  • The categories of Personal Information we collected about you

  • The categories of sources for the Personal Information we collected about you

  • Our business or commercial purpose for collecting that Personal Information

  • The categories of third parties with whom we share that Personal Information

  • The categories of Personal Information that each recipient received

  • The specific pieces of Personal Information we collected about you

Deletion Rights

You have the right, subject to certain exceptions defined in the CCPA and other applicable laws and regulations, to request that a company delete any of your Personal Information that it has collected from you and retained.

Non-Discrimination

California consumers also have the right not to receive discriminatory treatment if they exercise the rights listed herein.

Request and Verification Process

When you make a request, we may require that you provide information and follow procedures so that we can verify the request and your jurisdiction before responding to it. The verification steps we take may differ depending on the request you make. We will match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us verify your request.
You will be required to submit your first and last name and email address and may be asked to provide your telephone number or address so that we can verify the request. Please provide as much of the requested information as possible to help us verify the request. We will only use the information received in a request for the purposes of responding to the request.

Sale or Sharing of Personal Information

You have the right, subject to certain exceptions defined in the CCPA and other applicable laws and regulations, to request that companies stop selling your personal information and refrain from doing so in the future. We are not currently selling your Personal Information.

California Civil Code Section 1798.83 permits California residents to request a list of all third parties to which we, during the immediately preceding calendar year, have disclosed certain Personal Information for direct marketing purposes. We do not share Personal Information with other people or non-affiliated businesses for their direct marketing purposes. We are only required to respond to a customer request once during any calendar year. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information sharing that is covered will be included in our response.

     7.3.    Nevada Residents.

Although we do not sell Personal Information, Nevada residents have the right to submit a verified request directing us not to sell their Personal Information. If you are a Nevada resident, and would like to submit such a request, please send your request through any of the methods noted below.

     7.5.    Do Not Track.

Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. When a user turns on DNT, the browser sends a message to websites requesting that they don’t track the user. At this time, we do not track your or any other users’ Personal Information over time and across third party websites. We therefore do not respond to browser DNT signals. 8. Data Transfers.

We are headquartered in the United States, and have operations, entities, and service providers in the United States. We and our service providers may transfer your Personal Information to, or access it in, jurisdictions that may not provide levels of data protection equivalent to your home jurisdiction. We will take steps to ensure that your Personal Information receives an adequate level of protection in the jurisdictions in which we process it. If you are located in the European Economic Area, United Kingdom, or Switzerland, we strive to ensure an adequate level of protection is afforded to transferring your Personal Information out of the EU/EEA by implementing, if applicable and where required by law, an approved international transfer mechanism.
